By accessing or using the Chakaruna website, registering for a membership, purchasing event tickets, or participating in any Chakaruna programme, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using our services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or by a prominent notice on our website at least 14 days before they take effect. Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms.

Chakaruna provides a global conscious community platform offering: online community membership and access to digital content; cultural events, dialogues, embodied practices, and gatherings (both in-person and virtual); educational and wellness programming; and partnership and collaboration opportunities for organisations and individuals.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice where practicable. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.

To access certain features of our services, you must register for a membership account. When registering, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use of your account.

We offer two membership tiers: a free Community Member tier and a paid Supporting Member tier at USD 9.99 per month (or local currency equivalent). Paid memberships are billed monthly and may be cancelled at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by applicable consumer protection law.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in conduct harmful to the community, or if required by applicable law.

Chakaruna is a sacred, inclusive space. All members and event participants are expected to uphold the following community standards:

Violations of these standards may result in immediate suspension or termination of your membership without refund, and may be reported to relevant authorities where required by law.

When you register for a Chakaruna event, you agree to the specific terms and conditions for that event, which will be provided at the time of registration. General event terms include:

Refunds and Cancellations: Event ticket refund policies vary by event and will be clearly stated at the time of purchase. Where no specific policy is stated, tickets are non-refundable unless the event is cancelled or significantly changed by Chakaruna. In the event of cancellation by us, you will receive a full refund of the ticket price.

Photography and Recording: Events may be photographed or recorded by Chakaruna for documentation, promotional, and archival purposes. By attending, you consent to being photographed or recorded in group settings. If you do not wish to appear in recordings, please notify our team at the event. Individual portrait photography will always require separate explicit consent.

Health and Safety: You agree to comply with all health, safety, and venue regulations applicable to events you attend. Chakaruna reserves the right to refuse entry to or remove from an event any person whose behaviour poses a risk to themselves or others.

Force Majeure: We are not liable for any failure to deliver events due to circumstances beyond our reasonable control, including natural disasters, government restrictions, public health emergencies, or acts of God. In such cases, we will use reasonable efforts to reschedule or provide alternative arrangements.

All content on the Chakaruna website and in our materials, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of Chakaruna Co., Ltd. or its licensors and is protected by applicable intellectual property laws, including Thai copyright law, EU copyright directives, and US copyright law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use our website and content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our services without our express written permission.

The Chakaruna name, logo, and all related marks are trademarks of Chakaruna Co., Ltd.. Nothing in these Terms grants you any right to use our trademarks without prior written consent.

If you submit content to us (such as testimonials, photos, or feedback), you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and display that content in connection with our services, subject to our Privacy Policy.

Paid membership fees and event tickets are processed through our third-party payment processor. By providing payment information, you represent that you are authorised to use the payment method and authorise us to charge the applicable fees. All prices are stated in US Dollars (USD) unless otherwise specified. Currency conversion fees, if any, are the responsibility of the cardholder.

For recurring memberships, you authorise us to charge your payment method on a monthly basis until you cancel. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date.

We reserve the right to change our pricing with 30 days' notice. If you do not agree to a price change, you may cancel your membership before the new price takes effect.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

Chakaruna's community programmes, including embodied practices and wellness activities, are not a substitute for professional medical, psychological, or therapeutic advice. Participation in any physical or wellness activity is at your own risk. Please consult a qualified professional before participating if you have any health concerns.

To the extent permitted by applicable law, including the Consumer Protection Act B.E. 2562 (Thailand), the EU Consumer Rights Directive, and applicable US consumer protection statutes, we exclude all implied warranties. Nothing in these Terms affects your statutory rights as a consumer.

To the maximum extent permitted by applicable law, Chakaruna Co., Ltd. and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of our services.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD 100.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights in your jurisdiction.

You agree to indemnify, defend, and hold harmless Chakaruna Co., Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: your use of our services; your violation of these Terms; your violation of any third-party rights; or your violation of any applicable law.

Our website may contain links to third-party websites or integrate third-party services. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website or service. Your use of third-party services is governed by their respective terms and privacy policies.

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection provisions of your country of residence also apply and are not affected by this choice of law.

For users outside the EU: Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand, unless mandatory provisions of applicable law require otherwise.

For users in the EU: In addition to the above, you may also bring proceedings in the courts of your country of habitual residence. The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

For users in the USA: To the extent permitted by law, any dispute will be resolved through binding arbitration in accordance with the JAMS International Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required by applicable law. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law).

These Terms, together with our Privacy Policy and any event-specific terms, constitute the entire agreement between you and Chakaruna regarding your use of our services and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
